These Terms govern your use of the Quetis Photo App (the "Service"), operated by Quetis, LLC trading as "Quetis" ("we", "us", "our"). By accessing or using the Service you agree to these Terms.

1. The Service

Quetis is a web application that lets you capture, frame, edit, and export photos. Features and limits available to you depend on the plan you select.

2. Eligibility & Account

You must be of legal age in your jurisdiction to use the Service. You agree to provide accurate information, keep your credentials confidential, and are responsible for activity under your account.

3. Acceptable Use

You agree not to misuse the Service, including by:

  • using it for any unlawful purpose, fraud, or spam;
  • uploading content that infringes intellectual-property or privacy rights;
  • uploading content depicting minors in unsafe contexts, sexual content without consent, or otherwise harmful content;
  • interfering with the security or integrity of the Service (malware, probing, scraping, denial-of-service);
  • reverse-engineering, reselling, or redistributing the Service.

4. User Content

You retain ownership of photos and content you upload. You grant us a limited, worldwide, royalty-free license to host, store, process, and display your content solely as necessary to provide the Service to you. You are responsible for having all rights necessary to your inputs and exports.

5. Intellectual Property

The Service, its software, branding, and frame designs are owned by us and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your active plan.

6. Payments, Subscriptions & Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer-service inquiries related to billing and handles refunds in accordance with our Refund Policy and Paddle's Buyer Terms. Subscription term, renewal, fees, taxes, and billing frequency are governed by the plan you select at checkout and by Paddle's Buyer Terms.

7. Service Availability

We work hard to keep the Service available, but do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, all implied warranties are disclaimed.

8. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the Service ends and we may delete your account data after a reasonable export window.

9. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising from the Service is limited to the fees you paid us (via Paddle) in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages (including lost profits, data, or goodwill). Nothing in these Terms excludes liability that cannot be excluded by law (fraud, death, or personal injury).

10. Indemnity

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

11. Governing Law

These Terms are governed by the laws applicable at our principal place of business, and disputes will be resolved in the courts of that jurisdiction unless local consumer law gives you stronger rights.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes constitutes acceptance.
